Acceptance of Terms
By accessing or using our platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. We reserve the right to update these terms at any time; continued use constitutes acceptance.
Description of Service
Swimkef is a marketplace that connects pool owners (Hosts) with guests seeking private pool rentals by the hour. We act as an intermediary and are not a party to the rental agreement between hosts and guests. We are not responsible for the condition, safety, or legality of any listed pool.
User Accounts
You must create an account to make bookings or list your pool. You must be at least 18 years old. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.
Booking Process
Bookings are confirmed once payment is successfully processed. A confirmation is sent by email. The host's listed availability and pricing are binding at the time of booking. Swimkef reserves the right to cancel bookings in cases of fraud, safety concerns, or force majeure.
Payments & Refunds
All payments are processed securely through our certified payment provider. Prices are displayed inclusive of all applicable platform fees. Refunds for eligible cancellations are returned to the original payment method within 5–10 business days.
Cancellation Policy
Cancellations made at least 48 hours before the booking start time are eligible for a full refund. Cancellations made less than 48 hours in advance are not eligible for a refund. No-shows are not refunded. In exceptional circumstances, contact our support team.
Host Responsibilities
Hosts must ensure their pool meets all applicable safety and hygiene standards, is accurately described in their listing, and is available during confirmed booking times. Hosts must display any required permits or licenses and are responsible for maintaining a clean, safe environment.
Guest Responsibilities
Guests must respect the host's house rules, adhere to the pool's maximum capacity, and leave the space in good condition. Guests are responsible for any damages caused during their rental period and must supervise children at all times.
Prohibited Uses
Users may not use the platform for any unlawful purpose, to post false or misleading information, to harass other users, or to circumvent our payment system. Commercial filming, large events exceeding stated capacity, or any activity prohibited by the host are strictly forbidden.
Limitation of Liability
Swimkef acts as an intermediary platform. We are not liable for incidents, injuries, property damage, or losses that occur during a rental. To the maximum extent permitted by law, our total liability shall not exceed the amount paid for the booking in question.
Dispute Resolution
Any dispute arising from the use of our platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable law. You waive any right to participate in class action lawsuits against Swimkef.
Changes to Terms
Swimkef reserves the right to modify these Terms at any time. We will notify users of material changes by email or via an in-app notification. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
